Set out below are the terms and conditions for Westminster Christmas. Please read these details carefully, as this forms the basis of a sale agreement between you and Westminster Christmas when you purchase goods from us. If you proceed with a purchase of goods from us, you are acknowledging that your purchase is subject to these terms and conditions. Please note these terms and conditions may change from time to time. We recommend you regularly read them for any changes that may affect you. Please note these terms and conditions will prevail over anything to the contrary contained on this website.
1. Authority to Purchase
If you are under the age of eighteen (18) years, you cannot place orders with Westminster Christmas. If Westminster Christmas suffers losses as a result of transactions entered into by a minor, then Westminster Christmas may seek compensation for such losses from the parents or guardians involved.
2. Goods and Services Tax
Goods and Services Tax (GST) is applicable on all our products. All prices shown are in Australian dollars and include GST at 10%.
Our aim is to offer you the lowest prices in Australia. However, as a result of various reasons beyond our control, we reserve the right to alter prices at any time without notice to you. When price changes do occur we will update our website immediately we become aware of such changes.
From time to time we will advertise % off discounts. Such discounts are a reduction off the selling price of goods at the time. The discount does not apply to packing and freight charges. Further, these discounts cannot be used in conjunction with any other Specials that may apply at the time.
5. Availability of Goods
On occasion goods that are displayed on our website, and purchased by you, may not be available. Usually this is the result of timing differences or short supply from our overseas suppliers. If this occurs, we will email you and offer to despatch the balance of your order, plus a refund for the unsupplied goods.
6. Delivery Time
In most cases we are able to dispatch your order, from our Melbourne warehouse, within 4 days after receipt of your order. If your order is delayed beyond this time, for any reason, we will email you. PLEASE NOTE: Items purchased in any of our Special Sales will not be dispatched within the normal 4 day period, due to the volume of orders we may be handling.
7. Delivery Procedure
We will use Fastway Couriers to deliver your order to the Delivery Fee address shown on your order confirmation. The Fastway Courier driver will require a signature when delivering your parcel so please use a Delivery Fee address where someone will be present to sign. We do not accept responsibility for costs associated with orders that are returned to our warehouse, due to nobody being present at your nominated address, to receive and sign for goods.
8. Freight and Handling
Please note our postage rates do not include trees, large items or delivery to remote locations in Australia. In those instances, we will contact you to advise of the lowest available postage costs. If you then decide not to proceed with the order, we will refund you the total amount including postage paid. If you decide to proceed with the order, you will then need to pay for the additional postage costs.
9. Return/Cancellation Policy
We take pride in ensuring our customers satisfaction by offering high quality products. It is your responsibility to notify us if you feel you have received the wrong product, or the product is faulty, damaged in transit, or not fit for its intended purpose. You have 7 days from receipt of your order to dispatch your return. Please email us at “firstname.lastname@example.org” to obtain authorization to return, and details of where to send your return. We will not accept unsolicited returns. We will refund the value of the goods, but not any freight, paperwork and handling charges (please note the total of these charges usually exceed the freight costs you have paid). Returns must be in original Delivery Fee condition, including packaging. Freight costs of returning goods will be your responsibility. We also recommend that returns be sent by registered insured parcel post, as we do not accept liability for any returned goods lost in transit. Further, we will not refund if you cancel an order after the goods have been dispatched and are still in transit. Or if for any reason you do not take delivery of the goods and they are returned to our warehouse. Or if the goods arrive in a reasonable transit time, but miss a deadline you have set. In the event that you cancel your order after it has been picked and packed, but not dispatched, then we will refund your order amount less our handling costs.
10. Use of Our Products
All products on our website are for indoor use only, unless the product description specifically states for outdoor use. It is important that indoor products are not used for outdoors. When connecting power for outdoor use it is important to keep lead connections, adaptors and transformers protected from adverse weather. Always check with a qualified electrician for proper safety relating to outdoor power connections.
11. Force Majeure and Applicable Law
Westminster Christmas will not be liable for performing its obligation to customers, if such delay is caused by circumstances beyond the reasonable control of Westminster Christmas. Further, Westminster Christmas shall be entitled to a reasonable extension of time for performing such obligations. All legal aspects associated with Westminster Christmas will fall under the jurisdiction of Victoria, Australia.
12. SSL Encryption of Credit Card
At Westminster Christmas any credit card or financial information you provide is fully secure. This information is not stored by us. Secure Socket Layer (SSL) encrypted protection is used for Credit card transactions, and this data is sent directly to our order processing section.
SSL is a security protocol that validates the identity of a website and creates an encrypted Connection for sending credit card and personal data.
